Criminal Justice from the Eyes of A Libertarian

Criminal laws are formed to protect society from any kind of criminal atrocities that tarnish the society for human dwelling. There are many conducts that are threatening in a civil society, which libertarians are well-aware of.

Libertarian Vision

The conduct that undermines civil society includes (a) using unjustified force, (b) taking property by force or fraud, and (c) interfering with others' rights to non-harmful conduct. A sound criminal code aligns with John Stuart Mill's harm principle, which states that power should only be exercised over someone to prevent harm to others.

 

A well-functioning criminal justice system should focus on discouraging violations that protect civil society. However, our current system criminalizes many non-harmful actions, overwhelming itself with numerous "transgressors," only a few of whom are true criminals. Criminal justice system should be strict but should punish the ones who are guilty and not the ones who are innocent. To see the guilty from an unbiased lens is what liberals believe.

Conclusion

Libertarians propose a criminal justice system that actually works for the protection of civil society through its laws and regulations. They want to make a society that effectively advocates for the crimes that would otherwise be degrading to mankind.
