Why Does our Existing Justice System Needs a Revamp- From A Libertarian’s Lens?

When we look at our Indian judicial system, it is slow as a sloth. The judiciary desperately needs a revamp, as only when our judicial system is steadfast can our country’s crime rates diminish. But who will take this initiative- People or the Government? The Nirbhaya case of 2012, where a delhi girl was gang raped and murdered, shook the nation. The justice was given after seven long years. Is this what our country’s justice system is? This instance from the 2012 case has made the Indian Justice system significantly crippled showing how the Indian justice system is slow in its operation.

Libertarians and the Judicial System

Libertarians believe that what is termed a Crime should include force or fraud against another individual or group. They believe that the punishments that are usually given by our judiciary system do not include any harsh repercussions. Rape and murder are looked at with the eyes of lenience, whereas a poor thief is punished with a heavy prison sentence. 

When we are labelling crime we need to understand the actual essence of it. Crime for which an individual moves to court needs to serious enough and not petty. The most important thing that our judicial system needs to operate upon is to look into every case through the eyes of equality and discrimination, only then our judicial system can be revamped.

Conclusion

Our country’s judiciary needs to change for a better justice system to come into place. With a revamped judiciary, our country will undoubtedly be benefitted where there will be less discrimination and government interference. Equality before the law will prevail.
